Conflicto de competencia suscitado entre el Juzgado Séptimo Civil del Circuito de Barranquilla y el Consejo de Estado, Sección Tercera, Subsección C.
La Corte verificó que través del Auto 419/21 la Sala Plena de la Corporación resolvió la precitada controversia en el expediente ICC-4012, en el que asignó el conocimiento del asunto al Consejo de Estado, Sección Tercera, Subsección C.
Con dicha providencia se ordenó también remitir el expediente de tutela a dicha autoridad judicial y se ordenó a la secretaría general de dicha Corporación comunicar la decisión contenida en el precitado auto.
Pese a lo anterior, el asunto fue nuevamente repartido, aparentemente, por una doble remisión del conflicto.
Ante la necesidad imperiosa de respetar el principio de la cosa juzgada a efectos de no reabrir nuevas discusiones sobre lo decidido y salvaguardar la seguridad jurídica de la decisión previamente adoptada, se dispuso ESTARSE A LO RESUELTO en el Auto 419/21.

- Primero. ESTARSE A LO RESUELTO en el Auto 419 de 2021, mediante el cual se resolvió la controversia de la referencia, en el sentido de ordenar al Consejo de Estado, Sección Tercera, Subsección C, que tramite la tutela del señor Orlando José Álvarez Filizzola.
- Segundo. Por la Secretaría General de esta corporación, COMUNICAR la presente decisión a la parte demandante y al Juzgado
- Séptimo. Civil del Circuito de Barranquilla.
